These Terms and Conditions govern the booking, payment and provision of paid video consultations by Bodywise Heidelberg.

These Terms and Conditions apply to the booking and provision of paid video consultations offered via the online appointment booking system of Bodywise Heidelberg.
The offer is intended for self-paying patients. Billing through statutory health insurance does not take place unless expressly agreed otherwise.
The video consultation serves medical advice, medical assessment of a concern, discussion of existing findings and assessment of possible further diagnostic or therapeutic steps.
A video consultation cannot replace an in-person medical examination in every case. Whether consultation or treatment exclusively by remote care is medically justifiable is decided by the physician in each individual case.
In the case of acute symptoms, emergencies, severe pain, shortness of breath, impaired consciousness, chest pain or other urgent medical situations, the video consultation is not suitable. In such cases, the emergency services on 112, the medical on-call service on 116117 or an appropriate medical facility must be contacted immediately.
Booking takes place via the online appointment platform TidyCal. During booking, the person booking selects an available appointment and enters the required information.
By completing the booking process and confirming the paid booking, the person booking submits a binding offer to conclude a treatment contract for the selected video consultation.
The contract is concluded once the booking has been confirmed by the booking system. The appointment confirmation is usually sent by email.
The price shown in the booking system at the time of booking applies to the video consultation.
Payment is made directly as part of the online booking. Technical payment processing is carried out via Stripe, integrated through TidyCal.
Bodywise Heidelberg does not store complete credit card or payment data. Payment data is processed by the respective payment service provider.
The booking is only complete once payment has been successfully processed and the appointment confirmed.
The video consultation is a private medical self-payer service. The costs are to be borne by the patient unless reimbursement is provided by private health insurance, an allowance office or another payer.
Possible reimbursement by private health insurers, allowance offices or other payers is not guaranteed.
Where applicable, medical services are billed on the basis of the German Medical Fee Schedule (GOÄ). If a different fee agreement is required or desired in an individual case, this will be agreed separately.
The person booking is obliged to provide complete and accurate information when booking.
A stable internet connection, a suitable device and functioning camera and microphone are required to conduct the video consultation.
Existing findings, laboratory values, medical reports, medication lists or other relevant documents should be kept ready before the appointment or submitted by prior arrangement.
The patient is obliged to inform the physician fully and truthfully about relevant pre-existing conditions, medication, allergies, pregnancies and other circumstances important for the consultation.
The video consultation takes place online via Google Meet at the booked appointment time. After successful booking, the patient receives the access link to the video consultation by email.
Participation takes place via the Google Meet link sent. Depending on the device, an up-to-date browser or the Google Meet app may be required.
The patient is responsible for having a stable internet connection, a suitable device and functioning camera and microphone at the time of the appointment.
The access link sent must be treated confidentially and may not be passed on to third parties.
The patient must ensure participation from a protected and confidential environment so that third parties cannot listen to or follow the video consultation.
Recordings of the video consultation by the patient or third parties are not permitted without prior express consent.
The physician may refuse to conduct or continue the video consultation if consultation or treatment is not justifiable for medical, professional-law or technical reasons. In this case, it will be examined whether an alternative appointment, an in-person visit or a refund is possible.
Booked video consultations can be cancelled or rescheduled free of charge up to 24 hours before the agreed appointment.
In the event of timely cancellation, the amount already paid will be refunded or, if desired, used for an alternative appointment.
In the event of cancellation less than 24 hours before the appointment or in the event of a no-show, there is generally no entitlement to a refund unless the appointment can be assigned elsewhere.
If the patient appears late for the appointment, the consultation time may be shortened accordingly. In this case, there is no entitlement to extension of the appointment or partial refund.
If the video consultation cannot take place for technical reasons attributable to Bodywise Heidelberg, an alternative appointment will be offered or the amount already paid will be refunded.
Technical problems on the patient's side, particularly an unstable internet connection, missing camera or microphone function or late dial-in, generally do not entitle the patient to a refund.
Consumers generally have a statutory right of withdrawal for contracts concluded away from business premises and for distance contracts.
The withdrawal period is generally 14 days from conclusion of the contract. To exercise the right of withdrawal, the patient must inform Bodywise Heidelberg of the decision to withdraw from the contract by means of a clear statement, for example by email or letter.
For a service contract, the right of withdrawal expires if Bodywise Heidelberg has fully performed the service and performance only began after the patient expressly agreed that Bodywise Heidelberg would begin the service before expiry of the withdrawal period and at the same time confirmed that the right of withdrawal expires upon complete performance of the contract.
If the video consultation is carried out at the patient's express request before expiry of the withdrawal period, compensation for the value of the service provided up to withdrawal may be owed in the event of withdrawal.
Irrespective of the statutory right of withdrawal, the cancellation conditions above under section 9 apply.
The video consultation is based on the patient's statements and the documents provided. Medical assessments may be limited without a physical examination.
If a reliable medical assessment is not possible within the video consultation, the physician may recommend an in-person visit, further diagnostics or treatment by another suitable medical provider.
No specific treatment success is owed.
Bodywise Heidelberg processes personal data and health data exclusively in accordance with applicable data protection regulations.
External service providers are used for appointment booking and payment processing, in particular TidyCal for appointment booking and Stripe for payment processing.
Further information on the processing of personal data, the service providers used and the rights of data subjects can be found in the privacy policy of Bodywise Heidelberg.
Bodywise Heidelberg is liable without limitation in cases of intent and gross negligence as well as for damages resulting from injury to life, body or health.
Otherwise, Bodywise Heidelberg is liable for ordinary negligence only in the event of breach of essential contractual obligations. In this case, liability is limited to the foreseeable damage typical for the contract.
Liability for technical disruptions outside the sphere of influence of Bodywise Heidelberg is excluded to the extent permitted by law.
Communication in connection with booking, appointment confirmation, payment confirmation or cancellation may take place by email.
The patient is responsible for providing a valid email address and checking receipt of relevant emails, including spam or junk folders.
The law of the Federal Republic of Germany applies.
Should individual provisions of these Terms and Conditions be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
